1. Acceptance of Terms

By downloading, installing, or using the Gramly application ("the App"), developed by Krew Designs ("Developer"), based in the Republic of Argentina, you confirm that you have read, understood, and agreed to these Terms of Service ("Terms") in full.

If you do not agree with any of these terms, do not use the App. Continued use of Gramly after the publication of modifications constitutes acceptance of the updated Terms.

Nutritional and caloric analyses generated by AI (Claude by Anthropic) are approximate estimates, not exact or guaranteed values. Accuracy may be affected by:

• Photo quality, angle, and lighting
• Portion sizes (difficult to determine visually with precision)
• Regional variations in food preparation and ingredients
• Foods or dishes not in the AI model's knowledge base
• Photos of menus or signs rather than the actual plate

Use Gramly's results as a general guide and reference, not as exact values for critical health decisions. For precise measurements, consult a registered nutritionist or use a certified food scale.

4. Eligibility and Minimum Age

To use Gramly, you must be at least 13 years of age. By using the App, you represent and warrant that you meet this requirement.

EU residents between 13 and 16 years old may require parental or guardian consent under GDPR.

If you are under 13, do not use this application. If you are a parent or guardian of a minor who has used Gramly, contact us at krewdesigns.app@gmail.com to delete their data.

5. User Account

Gramly uses Google Sign-In as its sole authentication method. By creating an account, you also agree to Google's Terms of Service.

You are responsible for:

• Maintaining the security of your Google account
• All activity that occurs under your Gramly account
• Not sharing your device with others without first signing out of Gramly
• Notifying us immediately of any unauthorized use of your account

6. Free Model and Premium Subscriptions

Gramly operates under a freemium model with the following access tiers:

6.1 Premium Free Trial (7 days)

Both premium plans (monthly and annual) may be offered with a 7-day free trial through Google Play. Before starting it, please note:

• Duration: 7 consecutive days from the moment the subscription is activated.
• Cost during the trial: USD $0. You are not charged anything while the trial period lasts.
• Automatic conversion to a paid subscription: when the 7 days end, the subscription automatically converts into a paid subscription and Google Play charges you for the first full period, unless you cancel beforehand.
• Price after the trial: USD $6.99/month or USD $64.99/year, depending on the plan you chose, renewing automatically each subsequent period.
• How to avoid being charged: cancel at least 24 hours before the 7 days end, via Google Play → Account → Subscriptions → Gramly → Cancel. You keep Premium access until the trial period ends.
• Eligibility: determined exclusively by Google Play and normally limited to once per Google account. If your account is not eligible, the subscription starts as paid from day one and the App shows you the standard price before you confirm the purchase.
• Payment method: Google Play may require a valid payment method on your account in order to start the trial.

The trial duration, the final price, and the date of the first charge are always shown on Google Play's confirmation screen before you complete the purchase. That screen prevails in the event of any discrepancy with this document.

6.2 Promotional Offers

Occasionally, Gramly may offer you a 20% discount on the first month of the monthly plan. Conditions:

• It applies only to the monthly plan and only to the first period; subsequent renewals are charged at the standard price of USD $6.99/month.
• It is shown during a limited window (days 27 and 28 counted from App installation) and stops being available once that window closes.
• It cannot be combined with the 7-day free trial: by accepting the discount, the subscription starts as paid at the promotional price.
• The Developer may modify or discontinue any promotion at any time, without affecting subscriptions already purchased.

6.3 Billing and Renewal

Premium subscriptions are managed and billed exclusively through Google Play Billing. Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the current period ends.

Charges are made in the currency of your Google Play account and may differ from the USD price due to exchange rate variations and fees applied by Google.

6.4 Cancellation

You may cancel your subscription at any time via Google Play → Account → Subscriptions → Gramly → Cancel. Premium access continues until the end of the already-paid period. Cancellation does not generate a proportional refund for unused time.

6.5 Price Changes

The Developer reserves the right to modify subscription prices. Any changes will be notified at least 30 days in advance within the App and/or by email.

6.6 Refunds

Refunds are governed by Google Play's refund policy. The Developer does not process refunds directly; you must request them through Google Play within the deadline established by Google.

7. Acceptable Use

When using Gramly, you agree not to:

• Use the App for illegal, fraudulent, or unauthorized purposes
• Attempt to circumvent free plan limits by creating multiple accounts
• Attempt unauthorized access to our infrastructure (Supabase, Edge Functions)
• Reverse engineer, decompile, or disassemble the App
• Use the AI chat to transmit illegal, offensive, or malicious content
• Resell, sublicense, or commercialize access to Gramly without written authorization
• Use automated tools (bots, scripts) to interact with the App

Violations of these terms may result in immediate suspension of your access without refund of any paid subscription.

8. Intellectual Property

All source code, visual design, logos, graphics, text, animations, and interfaces of the App are the exclusive property of the Developer and are protected by Argentine intellectual property laws and applicable international treaties.

You are granted a personal, non-exclusive, non-transferable, revocable license to use Gramly solely on your personal devices and for your own non-commercial purposes. This license does not include the right to sublicense, distribute, modify, or create derivative works from the App.

The Claude AI model is owned by Anthropic, PBC. The Open Food Facts database is licensed under the Open Database License (ODbL). Use of Google Sign-In is subject to Google's terms.

9. Privacy

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By accepting these Terms, you also accept our Privacy Policy.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of fitness for a particular purpose
• Warranties of accuracy of AI-generated nutritional or caloric analyses
• Warranties of uninterrupted or error-free availability
• Warranties that AI results are appropriate for specific medical conditions

Service availability depends on third parties (Anthropic, Supabase, Google) over which the Developer has no direct control.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, punitive, or consequential damages
• Loss of device data (although we implement measures to prevent this)
• Health, medical, or nutritional decisions made based on App estimates
• Service interruptions caused by third parties (Anthropic, Supabase, Google Play)
• Health damages resulting from using App information without professional supervision
• Unauthorized access to your data through vulnerabilities in third-party services

The Developer's total liability to you, under no circumstances, shall exceed the amount you actually paid for the App during the last 12 months.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Developer, its collaborators, and representatives from any claim, legal action, damage, liability, loss, cost, or expense (including reasonable legal fees) arising from:

• Your use of the App in violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of third-party rights

13. Service Modifications

The Developer reserves the right to:

• Modify, suspend, or discontinue App features, with or without prior notice
• Update these Terms at any time; significant changes will be notified within the App
• Suspend or terminate access for accounts that violate these Terms
• Modify free plan limits with prior notice

14. Governing Law and Jurisdiction

These Terms are governed by and construed exclusively in accordance with the laws of the Republic of Argentina, including Law 25.326 (Personal Data Protection Act), Law 24.240 (Consumer Protection Act), and the Civil and Commercial Code.

Any controversy, dispute, or claim arising from or related to these Terms or the use of the App shall be submitted to the jurisdiction of the Ordinary Courts of the Autonomous City of Buenos Aires, with both parties waiving any other jurisdiction that may be applicable.

15. General Provisions

Severability: If any clause of these Terms is found to be invalid, illegal, or unenforceable, the remaining clauses shall continue in full force and effect.

No Waiver: The Developer's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other.

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding the use of Gramly.
